The Olomouc City Hall must, according to a currently non-final ruling of the regional court, return Thorn-type lamps to Horní náměstí. The city removed them 12 years ago despite the disagreement of the authors of the reconstruction of the historic center and replaced them with Urbanstar light fixtures. Architect Jan Šépka, co-author of the Horní náměstí reconstruction project, shared this information in response to a query from ČTK today. The city hall will decide on further steps after reviewing the ruling, said city hall spokesperson Jan Horejš.

The protracted dispute concerned the replacement of Thorn lamps with modern UrbanStar light fixtures. The city proceeded with this in 2014 despite the discontent of heritage protectors and the authors of the Horní náměstí reconstruction, who still oppose it. The regional court stated in 2016 that the city violated the authors' rights by replacing the lamps and ordered it to pay 100,000 crowns including an apology. However, according to the then ruling, the city hall was not required to return the original Thorn lamps to Horní náměstí.

Two years ago, the High Court confirmed that Šépka is entitled to an apology. According to the High Court, the city interfered with their copyright by replacing the light fixtures and devalued their project. However, the High Court simultaneously annulled other statements of the regional court from 2016, when the regional court awarded the architects compensation of 100,000 crowns but did not grant their request to restore the square's lighting to its original condition.
Therefore, the regional court re-examined the dispute. According to its spokesperson Igor Krajdl, the ruling was made on Monday, but the court cannot yet disclose further details about it. "No one was present at the announcement, and we did not deliver it to the parties,
so I cannot comment on it until then," Krajdl told ČTK today. According to Šépka, the court's verdict favored the authors of the Horní náměstí reconstruction, and the city hall will have to return the Thorn lamps to the center of Olomouc. It has 12 months from the moment the ruling becomes legally binding.

Architect Šépka is willing to sit down with representatives of the city hall at the negotiating table; there could also be a possibility of using lamps designed for the Horní náměstí reconstruction in 2001, which have come to be known as "paddles." Instead, the Thorn light fixtures were installed on the square following an agreement with the reconstruction authors.

According to Šépka, the city hall has failed for 12 years to credibly explain why it removed the original lamps. "It was shown in the court proceedings that they were not corroded, they were not technically unsatisfactory, and the reason for their replacement was not their light parameters. In other words – there was no reason to destroy this valuable component of the public space," Šépka noted.

The lawsuit regarding copyright protection was filed by architect Šépka in July 2014 when the city was considering replacing the lamps at Horní náměstí. However, the city hall's intention was not well received by heritage protectors or the authors of the square's reconstruction. Due to the dispute over the lighting design, the court issued a preliminary injunction in 2014 and prohibited the lamp replacement until the dispute was resolved, but the city exploited gaps in the proceedings and quickly replaced the Thorn lamps in September 2014.
