The homeowner must tolerate the tenants' satellites on the facade

Brno - Tenants do not need the owner's consent if they want to place an antenna or satellite on the facade of the building. Ombudsman Otakar Motejl informed ČTK of this today. He assumes that with the transition from analog to digital broadcasting system, complaints in this area will also increase. According to the public defender of rights, problems may arise, for example, in disputes over the placement of an antenna.
    According to the building law, it applies that only if antennas for receiving radio and television broadcasts exceed a length of 15 meters, including the supporting structure, their placement on the building must be reported to the building authority. Otherwise, the property owner must tolerate the equipment on the property so that the tenant has the option to receive broadcasts.
    Disputes between owners and tenants regarding antennas and satellites should be resolved by the building authorities. However, the building law is vague - it does not specify to what extent the authority should decide. It does not state whether it can determine where the antenna should be placed and how big it should be.
    Motejl emphasized that the problem should be addressed by the Ministry for Local Development in collaboration with the Czech Telecommunication Office. They should issue a joint statement and explain to building authorities how to proceed. The public defender of rights has already urged both institutions to do so in the past, said his spokesperson Iva Hrazdílková to ČTK.
