Brno – The city of Brno is seeking a tenant for premises in Bergl Palace on Moravské Square, known as Muzejka. The previous tenant, the company Gattamelata, was given notice terminating its lease in May 2023. However, disputes between the city and the company prevented the premises from being used. One of these disputes ended when the former tenant vacated the premises over the summer. Prospective tenants can apply until November 30. The city is asking for a monthly rent of CZK 119,000 for approximately 560 square metres of space, according to its website.
The premises available for rent include a main area and a mezzanine with a gallery, with entrances from both Moravské Square and the adjoining Lidická Street. "The premises are being rented unfurnished and require structural and technical modifications before operations can begin," the city said.
The last tenant was the company Gattamelata. The city justified terminating the lease by citing long-standing problems with payments of rent and utility advances, as well as unauthorised interior alterations that disregarded the building's heritage value. In response to the termination, the company described its eight years of operating in city-owned premises as incredibly difficult and called the city's leadership despotic and arrogant.
The city was involved in three legal disputes with the company. The first, concerning the eviction from the premises, ended after the tenant left voluntarily. In August, city councillors also brought the second dispute to a close, in which the company sued Brno over improperly charged service fees. Gattamelata sought CZK 1.2 million from the city. However, the Regional Court in Brno upheld a ruling ordering the city to pay CZK 231,000. Councillors decided that the city would comply with the court's order, Radka Loukotová of the City Hall press office said at the time.
The only unresolved dispute is the case in which Brno, in turn, is seeking outstanding rent from Gattamelata. Although the court initially issued a payment order for CZK 1.2 million, the company filed an objection. The court subsequently suspended the proceedings pending a final ruling in the dispute over service charges. The proceedings can therefore be expected to resume.
In late September and early October, the city also approved a unilateral set-off of the mutual claims. Once the set-off is applied, Gattamelata's claim against the city will be extinguished, meaning Brno will not pay the company anything.
Bergl Palace, also known as Bergler Palace, Bergl Villa or Muzejka, was built in the 1860s. The Neo-Renaissance building with a Neo-Gothic façade was designed by Viennese architect Heinrich Ferstel, who also designed the nearby Red Church and several other buildings in Brno. The building acquired the name Muzejka in the 1920s, when it belonged to the Agricultural Museum and housed Café Museum on the ground floor. The museum closed in 1943, but the building retained the name. It has been a listed heritage building since 1964.
